La controversia entre los precitados despachos tuvo su origen en las diferentes interpretaciones del factor territorial.
Ambos presentaron una serie de argumentos relacionados con el lugar donde se presentó y tuvo sus efectos la vulneración de derechos alegada por la parte demandante.
Se dirime la controversia con la remisión del expediente al Juzgado Cincuenta Penal del Circuito de Bogotá para que, de manera inmediata, tramite el proceso y adopte la decisión de fondo a que haya lugar.

- PRIMERO. DEJAR SIN EFECTOS el auto proferido el 25 de julio de 2023 por el Juzgado Cincuenta Penal del Circuito de Bogotá, con ocasión de la tutela promovida por Luisa Fernanda Flórez Barrios en contra de la Comisión Segunda Constitucional de la Cámara de Representantes.
- SEGUNDO. REMITIR el expediente ICC-4478 al Juzgado Cincuenta Penal del Circuito de Bogotá para que, de manera inmediata, tramite el proceso y adopte la decisión de fondo a que haya lugar en relación con la acción de tutela.
- TERCERO. Por intermedio de la Secretaría General de la Corporación, COMUNICAR esta providencia a las partes de la tutela y al Juzgado
- Décimo. Administrativo del Circuito de Cartagena.
